Terms of Service.

1. Acceptance of Terms

By accessing or using PestFree NZ ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform. These terms constitute a legally binding agreement between you and PestFree NZ.

2. Eligibility

• You must be at least 18 years of age to use this Platform
• Hunters must hold a valid New Zealand firearms licence where required for their proposed activities
• All users must provide accurate and truthful information
• You must be legally entitled to enter into binding agreements in New Zealand

3. Platform Purpose

PestFree NZ is a marketplace that connects landowners who need pest control services with licensed hunters and pest controllers. The Platform facilitates introductions, communication, and the creation of access agreements. PestFree NZ is not a party to any agreement between landowners and hunters.

4. User Responsibilities

All Users

• Provide accurate, complete, and current information in your profile
• Maintain the security of your account credentials
• Comply with all applicable New Zealand laws and regulations
• Treat other users with respect and professionalism
• Report any suspicious or inappropriate behaviour

Landowners

• Provide accurate property information including hazards, livestock, and boundaries
• Ensure you have legal authority to grant access to the property
• Comply with the Trespass Act 1980 regarding access permissions
• Disclose all known risks and hazards on the property

Hunters

• Maintain valid firearms licences and comply with the Arms Act 1983
• Adhere to the New Zealand Outdoor Access Code at all times
• Only operate within the boundaries and terms of signed access agreements
• Follow all safety protocols outlined in access agreements
• Carry appropriate insurance where applicable

5. Firearms Safety

All hunters using this Platform acknowledge and agree that:

• They must comply with the Arms Act 1983 and Arms Regulations 1992 at all times
• Firearms must only be used in accordance with the terms of signed access agreements
• The seven basic rules of firearms safety must be followed at all times
• Hunting dogs must be under control and wormed as required
• Night hunting is prohibited unless explicitly agreed to in writing by the landowner
• PestFree NZ bears no responsibility for firearms-related incidents

6. Outdoor Access Code Compliance

All users must acknowledge and respect the New Zealand Outdoor Access Code. This includes respecting private property, closing gates, not disturbing livestock, and leaving properties as you find them. The access agreements facilitated through this Platform are designed to comply with the Trespass Act 1980.

7. Access Agreements

Access agreements created through the Platform are legal documents between the landowner and hunter. PestFree NZ provides the template and digital signature functionality but is not a party to these agreements. Users are responsible for reviewing and understanding agreement terms before signing. Electronic signatures are legally binding under New Zealand law.

8. Prohibited Conduct

• Providing false or misleading information
• Using the Platform for any unlawful purpose
• Harassment, abuse, or threatening behaviour towards other users
• Attempting to circumvent the Platform to avoid accountability
• Creating multiple accounts
• Scraping, data mining, or automated access to the Platform
• Hunting outside agreed boundaries or terms
• Using firearms in an unsafe or unlawful manner

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, PestFree NZ shall not be liable for:

• Any injury, death, or property damage arising from pest control activities
• Any disputes between landowners and hunters
• The accuracy of information provided by users
• Any loss or damage resulting from reliance on information provided through the Platform
• Service interruptions or data loss

Nothing in these terms limits liability that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993 where applicable.

10. Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in prohibited conduct, or pose a risk to other users. Users may delete their own accounts at any time through account settings.

11. Dispute Resolution

Any dispute arising from these terms or use of the Platform shall first be attempted to be resolved through mediation. If mediation is unsuccessful, the dispute shall be resolved in the courts of New Zealand. These terms are governed by New Zealand law.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated terms.
